Corporate & Commercial

To register a company with the SECP, you need copies of the CNIC or Passport of all directors and shareholders, a proposed company name (3 options), the registered office address, and the Memorandum and Articles of Association. We assist clients in drafting these documents and completing the entire online incorporation process through SECP's e-services portal.

Company registration with SECP typically takes 1 to 3 working days once all documents are in order. The process can be expedited through SECP's digital platform. We recommend reserving the company name in advance to avoid delays.

There is no statutory minimum capital requirement for a private limited company in Pakistan. You can register with any amount of share capital. However, we advise that the capital should be commensurate with the nature and scale of the proposed business.

Family Law

A khula case generally takes between 3 to 6 months in Pakistan. The exact duration depends on the court's schedule and whether the opposing party contests the proceedings or fails to appear. We ensure all legal notices and documentation are prepared accurately to prevent unnecessary delays.

Khula is a divorce initiated by the wife in which she typically returns the dower (mahr) to the husband, while talaq is initiated by the husband through pronouncement. Both require notice to the Arbitration Council under the Muslim Family Laws Ordinance, but the procedures and legal grounds differ.

Pakistani courts decide custody based on the welfare of the child as the paramount consideration. Generally, the mother has the right of custody (hizanat) of male children until age 7 and female children until puberty, but this can be modified by the court based on the child's best interests, the parents' circumstances, and the child's own preference if of sufficient age.

Yes, overseas Pakistanis can file for divorce through a lawyer holding a valid power of attorney. The lawyer can represent them in the relevant family court, and remote appearances may be arranged in certain cases. The process can be managed largely from abroad with the right documentation.

Property & Real Estate

Overseas Pakistanis can buy property in Pakistan by executing a valid power of attorney in favor of a trusted person or their lawyer. The attorney can then complete the purchase, mutation, and registration on their behalf. All financial transactions should be made through banking channels.

Mutation is the process of recording the change of ownership in the land revenue register. It is the final and conclusive step that legally establishes the new owner's name in government records. Without mutation, the previous owner's name remains on the record, which can create complications for future transactions or inheritance.

Property title can be verified by obtaining a Fard (title deed) from the relevant Patwari's office or through the Punjab/Islamabad land record online portals. A complete due diligence also includes checking the chain of ownership, any encumbrances, and verifying the property matches the recorded dimensions and location. We conduct this verification as part of our property advisory service.
