Overseas Pakistanis invest billions into the local real estate market annually. However, physical absence makes these investments vulnerable to illegal occupation (Qabza) and forged ownership transfers.
Key Protective Measures
- Secure Valid Power of Attorney: Only grant Special Power of Attorney for specific tasks, avoiding General Power of Attorney whenever possible.
- Regular Property Audits: Engage local counsel to physically inspect the property and verify records with the local land revenue department (Patwari/CDA).
- File Injunctions Promptly: If an illegal occupation is suspected, a stay order must be sought from the Civil Court immediately.
